Throughout the site, the terms “I”, “we,” “us,” “my”, “the artist,” or “our” refer to Amy Loftus trading as Amy Loftus Art. By accessing this website, using its services, or purchasing from it, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use this website.

WEBSITE USE

By using this website, you agree to do so only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit the use of this website by any other person. You may not misuse this website, attempt to gain unauthorised access to it, interfere with its security or functionality, or use it in any manner that could damage the website, its content, or its reputation. This website is built and hosted on Squarespace, and certain services, such as checkout, payment processing, analytics, and email marketing, may be supported by Squarespace or connected third-party providers, depending on the site's current configuration.

PRODUCTS & AVAILABILITY

We make every reasonable effort to ensure that all artworks, prints, products, services, descriptions, dimensions, pricing, and availability displayed on the website are accurate and up to date. However, we do not guarantee that all content is always complete, current, or error-free. Because original artworks and handmade works are often unique, availability may change without notice.

We reserve the right to update, modify, discontinue, or remove products or services at any time.

PAYMENTS & ORDERS

We offer secure checkout through the payment methods enabled on this website. When you place an order through our website, you are making an offer to purchase the products listed.

Payment must be received in full before any order is shipped, delivered, or otherwise fulfilled, unless expressly agreed otherwise in writing. We reserve the right to refuse, cancel, or limit any order at our discretion, including in cases of pricing errors, product unavailability, suspected fraud, or breach of these Terms. If an order is cancelled after payment has been made, any amount due to be refunded will be returned using the original payment method, where possible.

All prices are listed in GBP and include VAT where applicable. We reserve the right to change prices at any time without notice.

Shipping costs, taxes, import duties, or other applicable charges are not included unless explicitly stated.

SHIPPING POLICY

Delivery is available to UK mainland only. We currently cannot ship to Northern Ireland due to new export rules.

Artworks and other products typically require a preparation period of 1–5 business days before shipment, unless stated otherwise. Delivery times are added to this preparation period and vary depending on destination, shipping method and carrier performance. Shipping costs are calculated at checkout unless stated otherwise. The buyer is responsible for providing accurate shipping information. We are not responsible for delays, failed deliveries, or additional costs resulting from incorrect shipping details provided by the buyer.

RETURNS & REFUND POLICY

Our returns, cancellations and refund terms are set out in our Returns and Refunds Policy. By placing an order, you agree to those terms.

TERMS OF SALE

Physical ownership of the artwork transfers to the buyer upon full payment, but all copyright, image rights, and other intellectual property rights remain with the artist unless explicitly agreed otherwise in writing. The buyer acquires ownership of the physical object only and does not acquire any right to reproduce, publish, license, distribute, alter, scan, digitise, tokenise, commercially exploit, or create derivative works based on the artwork or its image without prior written permission. All images, artworks, photographs, digital renderings, mock-ups, installation views, and other visual materials displayed on this website remain the intellectual property of the artist or respective rights holder, unless stated otherwise. These materials may not be copied, downloaded, reproduced, screenshot, stored, published, transmitted, distributed, altered, re-rendered, used for AI training, used to generate synthetic variations, used commercially, or incorporated into derivative works without prior written permission.

The buyer agrees to exercise reasonable care in preserving and protecting the artwork after delivery. We are not responsible for damage, deterioration, or loss occurring after the transfer of risk, except where mandatory law provides otherwise. The buyer may display the artwork privately. Any public exhibition, institutional loan, or commercial display should be communicated in advance to the artist where possible, especially for documentation and archival purposes. If the buyer later sells or otherwise transfers the artwork, we would appreciate being informed where possible for archival purposes. Where legally permitted, we may request basic details of the transfer and the identity of the new owner, but unless mandatory law or a separate written agreement provides otherwise, this is not a condition of ownership.

ACCURACY OF WEBSITE CONTENT

We strive to present artworks and products as accurately as possible. However, colours, textures, scale, and details may appear differently depending on screens, monitors, lighting conditions, photography, and device settings. Minor variations between the digital presentation and the physical work do not, in themselves, constitute a defect.

THIRD-PARTY SERVICES

This website may use third-party tools or integrations, including, but not limited to, Squarespace, payment processors, shipping providers, Squarespace Email Campaigns, Google Analytics, and Meta Pixel, depending on the site's current configuration. Squarespace documents that site owners may use commerce policies, privacy notices, and related disclosures for checkout and site operation, and that connected services may support payments, analytics, and email campaigns. We are not responsible for the independent policies, uptime, or security of third-party services. Your use of those services may also be governed by their own terms and privacy policies.
